I heard a politician say, "It matters if she's gay because as a justice she may have to decide on a same sex marriage law or DADT."

Actually, where Clarence Thomas is concerned, he falls under "The Oreo Exception" which states that anyone that obviously beholden to 'da man' is unlikely to show bias in favor of any minority.
The Oreo Exception also is known as "Uncle Tom's Law."
